Terms and Conditions for Camberwell Waste Collection Service

These Terms and Conditions set out the basis on which we provide waste collection services in and around Camberwell. By placing a booking with us, whether by telephone, email, online form or any other method, you agree to be bound by these Terms and Conditions. Please read them carefully before confirming any service.

1. Definitions

In these Terms and Conditions, the following expressions shall have the meanings set out below:

Customer means the person, business or organisation requesting waste collection services.

Company means the waste collection service provider operating in Camberwell and the surrounding areas.

Service means any waste or rubbish clearance, collection, removal, loading, transport or related activity provided by the Company.

Waste means any items, materials, rubbish, refuse, debris or other matter to be removed by the Company, subject always to applicable waste regulations and these Terms and Conditions.

2. Scope of Service

The Company provides waste collection and related services for domestic, commercial and other customers in Camberwell and nearby areas. Services may include household waste removal, bulky waste collection, office clearance, garden waste removal and similar activities that fall within lawful waste management practices.

The exact scope, volume, type of waste to be collected, timing and access arrangements will be as agreed during the booking process and confirmed by the Company. The Company is not obliged to remove any waste that is not clearly included in the agreed Service description or that is prohibited by law or regulation.

3. Booking Process

3.1 Requesting a Quote

Customers may request a quote for waste collection in Camberwell by contacting the Company via telephone, email or online enquiry. The Customer must provide accurate information about the type and approximate volume of waste, access details, property type, any time restrictions, and any other relevant information that could affect the performance of the Service.

3.2 Estimates and Confirmation

Any quote or estimate provided before attending the site is based on the information supplied by the Customer and is not binding if the actual waste or conditions differ materially from the description. The Company may revise the price after assessing the waste on site. The Customer will be advised of any revised charge before work commences. Proceeding with the Service after this explanation will be deemed acceptance of the revised price.

3.3 Making a Booking

A booking is made when the Customer accepts a quote or estimate and the Company confirms the date and time slot for the Service. Bookings are subject to availability and are not guaranteed until confirmed by the Company. The Customer is responsible for ensuring that contact details provided are accurate and up to date.

3.4 Access and Attendance

The Customer must ensure that the Company has safe and reasonable access to the waste at the agreed time. If access is not available, or if work cannot be carried out due to circumstances within the Customer’s control, the Company may treat the booking as a cancellation and charge a call-out or cancellation fee as described in these Terms and Conditions.

4. Payments and Charges

4.1 Pricing

Prices are generally based on factors such as the volume, weight and type of waste, the nature of the materials, access conditions, labour time and any additional services requested. The Company will endeavour to provide clear pricing information in advance, based on the details supplied by the Customer.

4.2 Payment Terms

Unless otherwise agreed in writing, payment is due in full upon completion of the Service on the day of collection. The Company may accept payment by cash, card, bank transfer or other methods as notified to the Customer. For certain bookings, the Company may require payment in advance or a deposit to secure the booking.

4.3 Late Payment

Where payment terms are agreed on account, any overdue amounts may incur interest or administrative charges as permitted by applicable UK law. The Company reserves the right to suspend further services to the Customer until all outstanding amounts are paid in full.

4.4 Additional Charges

Additional charges may apply in the following circumstances: where the quantity or type of waste exceeds what was initially agreed or quoted; where extra labour or specialist handling is required; where waiting time is incurred due to delays outside the Company’s control; or where special disposal arrangements or permits are required. The Customer will be advised of any such additional charges before they are incurred wherever reasonably possible.

5. Cancellations and Amendments

5.1 Customer Cancellations

The Customer may cancel or reschedule a booking by contacting the Company. To avoid charges, the Customer must provide reasonable notice, which is normally at least 24 hours before the scheduled collection time, unless the Company specifies a different notice period when the booking is made.

If the Customer cancels with less than the required notice, or if access is not provided on arrival, the Company may charge a cancellation fee or a minimum call-out charge to cover costs incurred.

5.2 Company Cancellations

The Company reserves the right to cancel or reschedule any booking at its discretion, including in circumstances where it is unsafe or unlawful to carry out the Service, where access is unsuitable, or where events beyond the Company’s control prevent attendance. The Company will endeavour to provide as much notice as reasonably possible and to offer an alternative appointment where feasible. The Company shall not be liable for any indirect or consequential loss arising from such cancellation or rescheduling.

5.3 Changes to Bookings

If the Customer wishes to change the time, date or details of the Service, the Company will use reasonable efforts to accommodate the request, subject to availability. Changes may affect the price of the Service, and any revised price will be communicated for acceptance before the Service proceeds.

6. Waste Types and Regulations

6.1 Compliance with Law

The Company operates in accordance with applicable UK waste management regulations, including duty of care requirements. All waste removed will be taken to licensed disposal or recycling facilities where required by law.

6.2 Prohibited or Restricted Items

The Company is unable to collect certain hazardous or prohibited materials, which may include but are not limited to: asbestos, clinical or medical waste, certain chemicals, pressurised containers, gas bottles, explosives, radioactive materials, and other items restricted by waste regulations or health and safety requirements.

The Customer must inform the Company in advance if any waste may be hazardous or require special handling. If hazardous or prohibited items are discovered on site, the Company may refuse to remove them, may withdraw from the Service, and may charge for any time spent or costs incurred.

6.3 Customer Responsibility for Waste Description

The Customer is responsible for ensuring that all waste presented for collection is accurately described, segregated where necessary and safe to handle. If the Customer provides inaccurate or incomplete information regarding the waste, the Company may adjust the price, decline the collection, or require additional measures to comply with regulations.

7. Customer Obligations

The Customer agrees to:

Ensure safe and reasonable access to the waste and the property, including sufficient parking space for the Company’s vehicles where required.

Ensure that waste is presented in a manner that is safe to lift and does not contain sharp, dangerous or contaminated items without prior disclosure.

Obtain any necessary permissions, consents or permits from landlords, managing agents, local authorities or others for the Company to access the property and remove waste.

Supervise children, pets and other third parties at the premises to ensure the safety of all persons present during the Service.

8. Liability and Limitations

8.1 General Liability

The Company will exercise reasonable care and skill when providing the Service. If the Company causes direct physical damage to the Customer’s property through negligence, it will, at its option, either repair the damage or compensate the Customer for reasonable losses, subject to the limitations set out in this section.

8.2 Exclusions of Liability

The Company shall not be liable for:

Any pre-existing damage or structural weakness, including but not limited to damage to pathways, driveways, surfaces or access routes not designed to bear the weight of vehicles or heavy loads.

Any loss or damage arising from inaccurate or incomplete information supplied by the Customer.

Any indirect, special or consequential loss, including but not limited to loss of profit, loss of business, or loss of opportunity, whether arising in contract, tort or otherwise.

8.3 Limits on Liability

Nothing in these Terms and Conditions excludes or limits the Company’s liability for death or personal injury caused by its negligence, for fraud, or for any other liability that cannot lawfully be excluded under UK law. Subject to the foregoing, the Company’s total liability to the Customer arising out of or in connection with any single Service shall not exceed the total price paid or payable for that specific Service.

9. Title and Risk

Ownership of waste passes to the Company once it has been loaded onto the Company’s vehicle and payment has been made or agreed in accordance with these Terms and Conditions. Until collection and loading occur, all waste remains the responsibility and risk of the Customer.

10. Delays and Events Beyond Control

The Company is not responsible for any delay or failure to perform its obligations where such delay or failure is caused by an event beyond its reasonable control. These events may include severe weather, traffic disruption, accidents, breakdowns, strikes, public emergencies, or any other circumstances that make it impractical or unsafe to carry out the Service as planned. In such cases, the Company will use reasonable efforts to rearrange the Service as soon as is reasonably practicable.

11. Complaints

If the Customer is dissatisfied with any aspect of the Service, the Customer should notify the Company as soon as possible, providing full details of the concern. The Company will investigate the matter and seek to resolve it in a fair and timely manner. Any claim relating to the Service should normally be raised within a reasonable period after completion, so that the Company can properly review and, where appropriate, remedy the situation.

12. Data Protection and Privacy

The Company may collect and process personal data provided by the Customer for the purposes of handling enquiries, managing bookings, delivering Services and administering accounts. Personal data will be handled in accordance with applicable UK data protection laws. The Company will take reasonable steps to safeguard personal information against unauthorised access, misuse or disclosure.

13. Variations to these Terms

The Company reserves the right to update or amend these Terms and Conditions from time to time. Any revised terms will apply to Services booked after the date on which the updated terms are made available. For ongoing or future bookings, the Company may notify Customers of significant changes where reasonably practicable.

14. Severability

If any provision of these Terms and Conditions is held to be invalid, illegal or unenforceable by a court or competent authority, that provision shall be deemed amended to the minimum extent necessary to make it valid and enforceable, or, if that is not possible, it shall be deleted. The remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms and Conditions, together with any written quotation or confirmation of booking issued by the Company, constitute the entire agreement between the Company and the Customer in relation to the provision of the Service. They supersede any prior discussions, correspondence or representations, whether oral or written, relating to the subject matter.

16. Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with any waste collection Service provided by the Company, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided, including any non-contractual disputes or claims.

By placing a booking for waste collection or related services in Camberwell, the Customer confirms that they have read, understood and agreed to be bound by these Terms and Conditions.
